District Administration clarifies legal position to Schools & Management that no screening of children for admission is allowed under RTE Act

In light of the directions of the Department of Education, Government of Punjab that the admission procedure be as per law and no child subjected to any harrassment, the District Magistrate-cum-Deputy Commissioner, Patiala,  Sakshi Sawhney issued an order stating that as per the RTE Act no school or person was allowed to conduct any screening for admission. To ensure compliance of the law, she also released an email id for parents to bring to light any grievance and assured strict legal action.

She said, “it has been brought to my notice by the district education officer (DEO) Secondary vide letter dated April 8,2023  that there have been instances where Schools have been subjecting students / parents to interviews/ tests/ interactions for admission to the school. Many parents are unwilling to give a formal/ written complaint as they fear that this may prejudice the chances of admission of their child in choice of their school.”

She informed that “The Right of Children to Free and Compulsory Education Act, 2009 (RTE Act) clearly prohibits any screening procedure by any school or person. No capitation fee and screening procedure for admission is to be adopted by any educational institute.’

Sawhney added that no school or person shall, while admitting a child, collect any capitation fee and subject the child or his or her parents or guardian to any screening procedure.

If any school is found violating the provisions and receives capitation fee, shall be punishable with fine which may extend to ten times the capitation fee charged. Similarly, if any school is found adopting of a screening procedure of a child, shall be punishable with fine which may extend to twenty-five thousand rupees for the first contravention and fifty thousand rupees for each subsequent contraventions.

DC highlighted the Supreme Court judgment in Society For Un-Aided Private Schools of Rajasthan vs Union of India, in which a bench headed by the Chief Justice of India held that “It was pointed out that the object of the provisions of Section 13(1) read with Section 2(d) is to ensure that schools adopt an admission procedure which is non-discriminatory, rational and transparent and the schools do not subject children and their parents to admission tests and interviews so as to deny admission.
I find no infirmity in Section 13, which has nexus with the object sought to be achieved, that is access to education.”

DC Sawhney informed the parents that “Section 32 of the RTE Act outlines the procedure for Redressal of Grievances where in any person having a grievance relating to the right of the child under this Act may make a written complaint to the local authority having jurisdiction i.e., DEO, Patiala.”

Therefore, in view to safeguard the interests of the children and their rights under the RTE Act, District Magistrate directed that the Statutory position as well as the judgments of the Hon’ble Supreme Court of India may be reiterated and widely publicized so that the parents, the School & their Managements are aware of the legal provisions and do not contravene them in any way.

She said that if any person having a grievance relating to the rights of the child under the Act may send an email to the DEO, Patiala

Orders direct that any contravention shall be dealt with strictly and necessary action as per law will be immediately taken.

Chandigarh, March 6, 2023: Tearing into the opposition for plundering the wealth of the state, the Punjab Chief Minister Bhagwant Mann on Monday said that no person involved in looting public money will be spared by the state government.

The Chief Minister, while slamming leader of opposition Partap Singh Bajwa for shielding the corrupt by criticizing action of Vigilance Bureau (VB) against tainted leaders of floor of house, said that his government has adopted zero tolerance policy against corruption and exemplary action will be ensured against the leaders involved in sins against the state.

He said that no one can stop him from acting against these culprits who have mercilessly robbed and ruined the state. Bhagwant Mann said that it is a sorry state of affairs that the Congress leaders are trying to patronize those people who have looted the wealth of the state by misusing the power given to them by people.

The Chief Minister unequivocally said that the corrupt leaders whether they are from ruling side or opposition won’t be spared at any cost. He assailed the Congress for being neck deep in corruption adding that the Congress leaders misused their positions to rob the public wealth. Bhagwant Mann assured the house that nothing can deter him from taking stringent action against the corrupt leaders.

Training his guns against the Congress leaders, the Chief Minister said that most of the Congress leaders sitting on opposition benches are tainted. He told Bajwa that though these leaders are sitting amongst him on these seats, they too will also have to pay for their sins very soon as action against them was inevitable. Bhagwant Mann said that the names of several Congress leaders figure in every crime against the state adding that his government will make them accountable for their sinister moves.

The Chief Minister said that though his government is duty bound to act tough against the corrupt leaders but the Congress has always protected such leaders. He reminded Partap Singh Bajwa that a former Chief Minister of his party had submitted a list of corrupt Ministers and MLAs during his tenure to the Congress high command. However, Bhagwant Mann quipped that instead of acting against these corrupt leaders, his high command squatted over the list to avert embarrassment for the party, which had exposed the real face of the Congress.

CM bats for making new experiments to make Agriculture a profitable venture

Ludhiana, February 12, 2023: Reiterating the firm commitment of the state government to make agriculture a profitable venture, the Punjab Chief Minister Bhagwant Mann on Sunday advocated for making new experiments in the field of agriculture to supplement the income of the farmers.

Presiding over the first of its kind initiative of Government- Farmers (Sarkar-Kisan) interaction (milni), which got massive response from the farmers here at PAU, the Chief Minister said that this unique endeavor is aimed at ensuring the well being of the farmers.

He said that active participation of farmers is the need of the hour to bail them out from the ongoing agrarian crisis. Bhagwant Mann said that due to ever escalating input costs and diminishing returns agriculture is no longer profitable venture.

The Chief Minister said that due to this the farmers of the state are on cross roads. He said that the sole motive of organizing this interaction is to reduce the gap between decision-makers and stakeholders so that policies are designed as per the needs of the farmers.

Bhagwant Mann called upon the farmers to shun traditional methods of agriculture and adopt new ultra-modern techniques for maximizing their profit adding that the state government will ensure fulsome support and cooperation to them.

The Chief Minister said that the state government is already pursuing the matter of providing Minimum Support Price (MSP) to the farmers on alternative crops with the Government of India.

He said that this will help in supplementing the income of the farmers on one hand and weaning away the menace of stubble burning on the other.

Bhagwant Mann said that the state government is also laying major thrust on the food processing sector and processing plants for Sugarcane, Leechi, Garlic, Kinnow and other fruits will soon be set up in the state.

The Chief Minister also said that the state government is also planning to boost the agro-industry in a big way.

He said that Punjab produces 80% of the total Basmati produced in the country adding that this production will be further enhanced in the coming days.

Bhagwant Mann said that this will further give fillip to the Basmati industry on one hand and supplement the income of farmers besides saving the precious natural resource in the form of water.

The Chief Minister gave a clarion call to the farmers to adopt Basmati cultivation across the state. He assured the farmers that the state government will make every effort to ensure that they do not suffer any sort of loss in cultivation of Basmati. Bhagwant Mann also said that every effort will be made to ensure that assured price is made available on Basmati cultivation.

The Chief Minister said that the state government is also mulling to enhance the cultivation by optimum utilization of the canal water. He said that the irrigation network across the state will be further spruced up to benefit the framers. Bhagwant Mann said that all out efforts will be made to ensure that water reaches even at the tail end villages.

The Chief Minister said that in a major pro-farmer initiative, no power cut was imposed in the state during the previous paddy season due to which farmers got uninterrupted and regular supply of power.

He said that due to the efforts of his government the power generation in the state has been enhanced by 83%. Bhagwant Mann said that owing to strenuous efforts made by his government the supply of coal for power generation from Pachwara coal mine has resumed after a long time.

The Chief Minister said that as the state now has surplus coal with it, the Punjab government has also urged the Union government to give consent to coal supply to the private thermal plants.

He said that the state government is providing corruption free governance to the people and several initiatives have been taken in every sector. BhagwantMann said that till now more than 9000 acres of land have been recovered from under the illegal occupation adding that this drive will continue in coming days too.

The Chief Minister further said that his government has broken the backbone of the sand mafia by bringing transparency in the sand mining. Bhagwant Mann said that 16 public mines have been dedicated to the masses thereby ensuring pit head price of sand to Rs 5.50 per cubic feet.

He categorically said that the sand mafia that had flourished during the previous government regimes will no longer exploit the people.The Chief Minister also reiterated the firm commitment of his government to make Punjab a ‘drug free state’.

He said that the menace of drugs is being dealt with a heavy hand and a zero tolerance policy is being adopted against the drug peddlers. Bhagwant Mann said that sporting activity is being promoted in the state along with opening of new avenues of employment to channelize the unbounded energy of youth in a positive direction.

The Chief Minister also called upon the officers especially the deputy Commissioners and Additional Deputy Commissioners to maximize their field visits, especially in villages, and interactions with the people by going to villages.

He said that it is the need of the hour to facilitate the people in getting their day-to-day works done easily besides ensuring good governance to them. Bhagwant Mann said that this will help in better functioning of the offices along with better acquaintance with the ground realities.

Meanwhile, during this Sarkar-Kisan Milni held at Punjab Agriculture University around 15,000 farmers registered themselves.

Renowned Punjabi singer and lyricist Debi Makhoospuri and Raj Tewari enthralled the audience with their spellbound performances.

Air Marshal Amar Preet Singh will take over as the new Vice Chief of Air Staff on 01 February 2023. He will succeed incumbent Air Marshal Sandeep Singh, who will retire on Tuesday

Amar Preet Singh was commissioned as a fighter pilot in the Indian Air Force on 21 December, 1984. In a distinguished career spanning 38 years, he has flown a variety of fighter and trainer aircraft with more than 4900 hours of operational flying.

He is a Qualified Flying Instructor and an experimental test pilot with service flying on a variety of fixed wing and rotary wing aircraft.

Amar Preet Singh is an alumnus of Defence Services Staff College, National Defence College and National Defence Academy.

Air vice Marshal Amar Preet Singh, was presented the Ati Vishisht Seva Medal (AVSM) by the President of India in a grand Defence Investiture Ceremony held at the Rashtrapati Bhavan on 19 Mar 2019.

ਪੁਲੀਸ ਵਿਭਾਗ ਵਿੱਚ ਨਿਯਮਾਂ ਅਨੁਸਾਰ ਤਰੱਕੀਆਂ ਨਾ ਹੋਣ ਦਾ ਭਗਵੰਤ ਸਿੰਘ ਮਾਨ  ਸਰਕਾਰ ਨੇ ਸਖ਼ਤ ਨੋਟਿਸ ਲਿਆ ਹੈ। ਸਰਕਾਰ ਨੇ ਸਥਾਨਕ ਰੈਂਕਾਂ ਵਿੱਚ ਤਰੱਕੀ ਦੇ ਨਿਯਮਾਂ ਵਿੱਚ ਬਦਲਾਅ ਕਰਕੇ ਨਵੀਂ ਨੀਤੀ ਬਣਾਉਣ ਦਾ ਫੈਸਲਾ ਕੀਤਾ ਹੈ। ਸਰਕਾਰ ਨੇ ਫੈਸਲਾ ਕੀਤਾ ਹੈ ਕਿ ਸਿਰਫ਼ ਬਿਹਤਰ ਕਾਰਗੁਜ਼ਾਰੀ ਵਾਲੇ ਅਧਿਕਾਰੀਆਂ ਅਤੇ ਕਰਮਚਾਰੀਆਂ ਨੂੰ ਹੀ ਵਿਸ਼ੇਸ਼ ਸ਼੍ਰੇਣੀ ਤਹਿਤ ਲੋਕਲ ਰੈਂਕ ‘ਤੇ ਤਰੱਕੀ ਦਿੱਤੀ ਜਾ ਸਕਦੀ ਹੈ।

ਲੋਕਲ ਰੈਂਕ ਤੇ ਤਰੱਕੀ ਕਿਸੇ ਵੀ ਨੇਤਾ ਜਾਂ ਅਧਿਕਾਰੀ ਦੀ ਸਿਫ਼ਾਰਸ਼ ਤੇ ਨਹੀਂ ਦਿੱਤੀ ਜਾਵੇਗੀ। ਜਾਣਕਾਰੀ ਮੁਤਾਬਕ ਹੁਣ ਤੱਕ ਦੀ ਪਾਲਿਸੀ ‘ਚ ਕਾਂਸਟੇਬਲ ਤੋਂ ਲੈ ਕੇ ਇੰਸਪੈਕਟਰ ਤੱਕ ਖਾਸ ਹਾਲਾਤ ‘ਚ ਲੋਕਲ ਰੈਂਕ ਦਿੱਤੇ ਜਾਣਗੇ। ਸਰਕਾਰ ਦੀ ਇਸ ਨਵੀਂ ਨੀਤੀ ਵਿੱਚ ਮੁਲਾਜ਼ਮਾਂ ਦੇ ਮਾਣ ਭੱਤੇ ਦੀ ਰਾਸ਼ੀ ਵਿੱਚ ਵੀ ਵਾਧਾ ਕੀਤਾ ਜਾਵੇਗਾ।

ਪੁਲਿਸ ਮੁਲਾਜ਼ਮ ਸਿਵਲ ਵਰਦੀ ਵਿੱਚ ਹਥਿਆਰ ਲੈ ਕੇ ਨਹੀਂ ਜਾ ਸਕਣਗੇ

ਸਰਕਾਰ ਨੇ ਪੁਲਿਸ ਮੁਲਾਜ਼ਮਾਂ ਨੂੰ ਹਦਾਇਤਾਂ ਦਿੱਤੀਆਂ ਹਨ ਕਿ ਹੁਣ ਸਿਵਲ ਵਰਦੀ ਵਿੱਚ ਕੋਈ ਵੀ ਵਿਅਕਤੀ ਹਥਿਆਰ ਨਹੀਂ ਲੈ ਕੇ ਜਾਵੇਗਾ। ਇਸ ਨਾਲ ਲੋਕਾਂ ਵਿੱਚ ਡਰ ਦਾ ਮਾਹੌਲ ਬਣਿਆ ਹੋਇਆ ਹੈ। ਵਿਸ਼ੇਸ਼ ਆਪਰੇਸ਼ਨਾਂ ਦੌਰਾਨ ਹੀ ਹਥਿਆਰ ਲੈ ਜਾ ਸਕਦੇ ਹਨ ਅਤੇ ਸਿਰਫ਼ ਉਹੀ ਹਥਿਆਰ ਹਨ ਜੋ ਛੁਪਾਏ ਜਾ ਸਕਦੇ ਹਨ। ਜੇਕਰ 2 ਕਰਮਚਾਰੀ ਕਿਸੇ ਕੇਸ ਵਿੱਚ ਅਪਰਾਧੀਆਂ ਨੂੰ ਫੜ ਲੈਂਦੇ ਹਨ ਤਾਂ ਦੋਵਾਂ ਨੂੰ ਤਰੱਕੀ ਮਿਲ ਸਕਦੀ ਹੈ।

 ਇਨ੍ਹਾਂ 7 ਕਿਸਮਾਂ ਦੇ ਕੇਸਾਂ ਤੇ ਹੀ ਲੋਕਲ ਰੈਂਕ ਮਿਲੇਗਾ

  1. ਕਿਸੇ ਅੱਤਵਾਦੀ ਨੂੰ ਮਾਰਨ ਜਾਂ ਫੜਨ ‘ਤੇ।
  2. ਗੈਂਗਸਟਰ ਨੂੰ ਫੜਨ ਜਾਂ ਵੱਡੇ ਅਪਰਾਧ ਨੂੰ ਹੱਲ ਕਰਨ ਦੀ ਭੂਮਿਕਾ ‘ਤੇ।
  3. ਐਨਕਾਊਂਟਰ ਕਰਨ ਵਾਲੇ ਪੁਲਿਸ ਮੁਲਾਜ਼ਮ ਨੂੰ।
  4. ਕੱਟੜ ਅਪਰਾਧੀ A ਅਤੇ B ਸ਼੍ਰੇਣੀ ਨੂੰ ਫੜਨ ਜਾਂ ਮਾਰਨ ‘ਤੇ।
  5. ਸੂਚਨਾ ‘ਤੇ ਹਥਿਆਰਾਂ ਦਾ ਵੱਡਾ ਕੈਸ਼ ਫੜਿਆ।
  6. ਸਮੱਗਲਰਾਂ ਦਾ ਗਠਜੋੜ ਤੋੜ ਕੇ ਦੋਸ਼ੀਆਂ ਨੂੰ ਗ੍ਰਿਫਤਾਰ ਕਰਨ ਤੇ।
  7. ਜਦੋਂ ਇੱਕ IO ਨੂੰ ਜਾਂਚ ਦੌਰਾਨ ਵੱਡੀ ਲੀਡ ਮਿਲਦੀ ਹੈ, ਜਿਸ ਨਾਲ ਦੋਸ਼ੀ ਤੱਕ ਪਹੁੰਚ ਸਕਦਾ ਹੈ।

GATKA show included in the Republic Day celebrations

Bathinda, 25 January 2023: In a significant decision, Gatka show a traditional Sikh martial art has been included in the cultural programs to be presented during the 74th Republic Day celebrations to be held in the Shaheed Bhagat Singh stadium of Bathinda.

Chief Minister Bhagwant Singh Mann will unfurl the national flag on 26th January.

Gatka is an only one of its kind and inexpensive art to defend & display fighting skills and a better exercise for self-control. Gatka originated in the Punjab long time ago. There has been a revival during the 20th century, with an International Gatka Federation was founded in 1982 and gatka is now popular as a sport or sword dance performance art and is often shown during Sikh festivals.

Manmeet Singh Sidhu Advocate and Gursewak Singh Sidhu Advocate welcomed the decision of the district administration to include the Gatka show in the Republic Day program.They said Gatka is emerging popular and last year National Gatka Association of India (Regd) organised 10th National Gatka Championship 2022 (Men) at Panjab University, Chandigarh in which 16 teams participated.

Chandigarh, 8 January 2023: A meeting of Punjab Civil Service Association was held today under the chairmanship of its President Rajat Oberio.

Around 80 PCS officers attended the meeting, which included Sukhpreet Singh Sidhu, Lateef Ahmed, Sakattar Singh Bal, Avikesh Gupta, Major Amit Sareen , Amarjit Singh Bains, Pooja Syal and Ankur Mohinderoo.

The meeting deliberated various issues, including case of Tarsem Chand which is still pending despite a clear cut report submitted by the SIT. The association also demanded that government should register FIR against the people who conspired to frame Tarsem Chand.

The meeting also resolved that all the PCS officers in the state shall proceed on mass casual leave for the coming week from 9 January 2023.

The meeting resolved that government should constitute a high-level committee to investigate the current arrest of Narinder Singh Dhaliwal, which they termed as illegal, seeking its report by 13th January 2023.

The meeting also decided to submit a complaint to the Chairman of Punjab Police Complaints Authority Satish Chandra retired ACS regarding case of Tarsem Chand and Narinder Dhaliwal.

The Executive Body of the Punjab PCS Officers Association met over VC on 7th Jan to deliberate on the issue of the arrest of RTA Ludhiana on 6th. A fact finding team of 5 officers was tasked for determining the issue surrounding the illegal arrest. Preliminary, the following concerns have come to light after the deliberations :-
1. While claiming it an Organised crime, bureau has refrained from disclosing the source of money and no individual or transporter has been named in the case. . Just to make it more sensational, these terms have been used recklessly to defame the officer, cadre and even the department.
2. Motive, demand and acceptance…nothing is established and the whole episode made to happen in undue haste and in an illogical manner.
3. The case is based on the statement of complainant Satnam Dhawan who has been a habitual complainant and having and an FIR (FIR No 0008 dt. 18.1.2021 at Sadar Khanna) registered against him for blackmail (to mention an evidence)
4. About the video that is being put out as a cogent evidence where a person allegedly in intoxicated state of mind, sitting in a tavern as per media reports is making some statements which are mere hearsays. It also seems more pre-mediated. Such a video can never be considered concrete evidence against the officer of Government.
5. Had the officer been involved in such acts , he would have never been cooperated in the investigation. He went to the office of vigilance in good faith to co-operate in certain vigilance case. It is too ungraceful and arbitrary to arrest such an officer without any prior notice or following a due procedure.
It is the same vigilance department which has conspired to implicate a PCS officer earlier two and half years ago in connivance with transport mafia and despite an electronic evidence to this conspiracy, neither any action was initiated against the delinquent vigilance officials nor even they were transferred from their present postings to say the least.
Association takes this step of the vigilance in furtherance to their earlier ill designs to defame PCS officers.
The association is aghast at the level of high handedness and overstepping of legal process by the Vigilance department and expressed deep concern at the state of affairs. It has been decided to meet again on 8th Jan to decide the further course of action against such chosen agenda to defame officers of a premier service.

Chandigarh, January 7, 2023: Bir Devinder Singh, former Deputy Speaker, Punjab Vidhan Sabha Speaker has demanded the withdrawal of the arrest warrant issued against senior Punjab IAS officer Jaspreet Talwar by the National Commission for Scheduled Castes.

“It is shocking to learn that the National Commission for Scheduled Castes, exercising the powers of the Civil Court under Article 338(8) of the constitution of India has ordered the arrest of Ms. Jaspreet Talwar IAS currently serving as Principal Secretary, Department of School Education, Govt of Punjab.

The Court officer of the National Commission for Scheduled Castes under the direction of the Commission has sent the Warrants of Arrest to the Director General of Police, Punjab with the direction to arrest Ms. Jaspreet Talwar IAS and produce her in the Chamber of the Chairman of the National Commission for Scheduled Castes at 11.00 AM on 17th of January 2023 at NCSC Headquarters in Delhi,” said Bir Devinder Singh.

“Notwithstanding the statutory powers of the commission to issue a warrant of Arrest for the non-compliance of the Commission’s order, but in the case of Ms. Jaspreet Talwar the action of the NCSC is seemingly brutally harsh whereas. It is categorically mentioned in the text of the warrant that Jaspreet Talwar Principal Secretary, Department of School Education, Govt of Punjab was duly served with summon to attend the hearing before the commission on 02.01.2023, but she failed to attend the hearing.

Therefore, the National Commission for Scheduled Castes, exercising the powers of the Civil Court under Article 338(8) of the constitution of India has ordered the arrest of Jaspreet Talwar IAS currently serving as Principal Secretary, Department of School Education, Govt. of Punjab,” he noted.

“Though I’m not privy to the reasons as to why Jaspreet Talwar was unable to attend the hearing of the commission as required by its summons, she may be having some cogent reason for not being able to comply with the order of the commission on a stipulated date and time.

Moreover, it’s the first chance for the Civil Servant therefore given natural justice, Ms. Talwar must be given a fair opportunity to explain her inability to skip the meeting of the Commission. Jaspreet Talwar is a forthright Civil servant of the State of Punjab with impeccable integrity and she has served the State of Punjab and its people in the finest manner with utmost dignity and honesty.

Therefore I would beseech the majesty of the Commission, to relook into the issuance of the Arrest warrants, and rather She must be given a date to appear on her own before the commission. I would urge the Chairman of the NCSC Sh. Vijay Sampla to revisit the whole issue with wisdom and compassion and if it is feasible within the ambit of law then without any malice and prejudice against the officer in question, the arrest warrant must be quashed or withdrawn, under the accepted principles of transparent fairness and Natural justice,” added Bir Devinder.
